Jeema Rape and Murder Case

Session Case No. 117 of 2012 [The State V/s. Nishoo and others]

Shrimati Dhani was a victim of gang rape from District Tando Allahyar, Sindh. The accused forced her to consume poison after committing rape, which led to her death. The panchait (local council) advised the victim’s family to proceed with the burial rites of their daughter and refrain from registering an FIR against the accused, assuring them that the panchait would reach a decision within three days. However, the panchait refused to take any action against the accused afterwards.

Therefore, the victim’s mother Jeema lodged an FIR against the accused at Piaro Lund police station. In order to proceed with the investigation of the aforementioned offences the Investigating Officer exhumed the grave of the deceased only to find that the dead body of the victim was missing. The police officials failed to investigate and refused to lodge an FIR in relation to the missing body of the victim. The accused in connivance with the police officials threatened the victim’s family forcing them to flee their village and shift to Karachi.

Subsequently, Jeema filed a Criminal Transfer Application to have Session Case transferred from Hyderabad to Karachi. Further, a second FIR was lodged in relation to missing body of the victim Jeema on the basis of which Session Case No. 882 of 2011 proceeded before Additional Session Judge, Hyderabad.

A Criminal Transfer Application was filed before the Honourable High Court of Sindh to have the aforementioned cases transferred from Hyderabad to Karachi, which was allowed. The trial in respect of both the aforementioned cases is currently proceeding in Karachi.
