Zunaira Rape Case

Zunaira, a teenage girl, worked as a maid/domestic servant and was raped by one of her employers while working in the accused’s family home. As a result of the rape incident Zunaira attempted to commit suicide.

FIR No. 261/2013 was lodged in relation to the offence of rape. However, through an Administrative Order passed by the XIVth Judicial Magistrate at Karachi (South) the accused was released due to the recommendation of the police since there was insufficient incriminating evidence. It is important to note that, the concerned Magistrate had passed an Order without taking into consideration the DNA Test Report of the victim.

Subsequently, a Constitutional Petition was filed in order to set aside the Administrative Order, direct the Chief Secretary Sindh and Inspector General Police to initiate an enquiry into illegal actions of the Investigating Officer and issue binding guidelines for the protection of working women.

The Honourable Sindh High Court was pleased to dispose of the matter by setting aside the Order of release of the accused person with directions to the concerned Sessions Judge to transfer/assign the matter to some other Judicial Magistrate for the passing of an appropriate order.
