Sana Case
Facts: The essential details of the prosecution’s case, as outlined in the First Information Report (FIR), indicate that the complainant, Mst. Sana, filed the FIR asserting that she had entered into a Nikah with Arif Shah. Due to restrictions imposed by her family, she communicated with him via phone in secrecy. However, one day, she received a call from an unidentified individual who identified himself as Najeeb Ahmed. He issued threats, claiming to have knowledge of both her and her husband, and coerced her into conversing with him, warning that he would inform her father if she did not comply. On June 25, 2023, at approximately 1:00 PM, Najeeb contacted her again, insisting that they meet. Feeling compelled, she agreed to meet him, after which he took her to a location where he raped her. He further threatened her and repeated this act multiple times while brandishing a pistol. Consequently, the FIR was filed. Trial was conducted and accused was found guilty.
Judgment: The accused Najeeb Ahmed @ Boby son of Nazeer Ahmed is hereby convicted U/s. 265-H(ii) Cr.P.C. for the offence punishable under section 376 PPC and sentenced to suffer rigourous imprisonment for10 years and to pay fine of Rs.1,00,000/- (one lac) and in case of default of payment of fine he will further suffer simple imprisonment for six months only. Accused is also convicted for the offence for the offence punishable under section 506-B PPC and scented to suffer RI for three years and to pay fine of Rs.50,000/- and in case of default of payment of fine he will further suffer SI for three months. The accused is also awarded the benefit of section 382-B PPC and his sentence will be counted from the date of his arrest i.e., 06.09.2023. Both the sentences will run concurrently.
